          What if Edward Snowden were tried?

          Legally Speaking: Special Edition presents “The Trial of Edward Snowman,” moderated by UC Hastings Professor Evan Lee.

          Professor Evan Lee recently filmed a special edition of Legally Speaking that presents the hypothetical trial in absentia of “Edward Snowman” (based on Edward Snowden). The filming took place at WETA in Washington, D.C., and will air later this year.

           

          Participants:

          • Gen. Michael Hayden, Former Director, NSA & CIA;
          • Prof. David Cole, top expert on national security versus civil liberties;
          • Charles Savage, Pulitzer-Prize winning New York Times reporter and expert on the NSA program;
          • Former U.S. Attorney Joe Russoniello;
          • Top defense lawyer Abbe Lowell; and
          • Former U.S. District Judge Nancy Gertner.

          “Being on the set of this program was a spellbinding experience,” says Prof. Lee. “These experts got so wound up in the fact pattern and, by the end, were arguing so passionately for their viewpoints.           The discussion starts with how the press and the NSA deals with leaks; how the government approaches the prosecution of such leaks; how the defense plans for trial, and finally the panelists' judgments about the leaker and the government.
