Improving the Military's Response to Sexual Assault

Today Provost & Academic Dean Elizabeth L. Hillman will participate in a second day of public hearings as a member of a federal advisory committee on sexual assault in the military.

The Comparative Systems Committee, which she chairs, issued an interim report yesterday with some 77 recommendations (supported by hundreds of findings) for improving the military's response to sexual assault. Today, she will report on a separate statement in which she supports removing the discretion to prosecute from the chain of command.

“I support proposals to rely on impartial, independent prosecutors instead of commanders to exercise prosecutorial discretion in the military justice system. We're making recommendations for improvements in areas that haven't yet received much attention,” says Hillman, “including leveling the playing field for defense counsel in sexual assault cases, reducing the pressure to prosecute in every situation, improving the accuracy and comparability of survey data, and increasing the authority of the military judge to hear pre-trial motions and to sentence."
